Sir,
We have for reference the PIB press release cited under reference above wherein the proposal of Engineer-in-Chief of the Military Engineering Services (MES) to abolish 9304 posts, out of 13157 vacancies in the basic and Industrial workforce (Civilian Posts) in the Military |Engineering Services, duly approved by the Hon’ble Raksha Mantri Ji, has been announced. The press note further states that this decision has been taken in line with the recommendation of the committee of experts headed by Lt. Gen. Shekatkar.
In this connection, while expressing our strong objections and protest, we seek your kind intervention since the Cabinet Secretariat is responsible for the administration of the Government of India (Transaction of Business) Rules, 1961 and the Government of India (Allocation of Business) Rules 1961, facilitating smooth transaction of business in Ministries/ Departments of the Government.
We draw your kind attention to the Second Schedule (Rule 3) of the Government of India (Allocation of Business) Rules 1961 wherein the business of “Review of Staffing of Government establishments with a view to securing economy” has been entrusted to the Ministry of Finance, Department of Expenditure under Part “B” Clause No.3 of the extant rule and hence Shekatkar committee does not have any powers to deal with the subject. Thus, both the recommendations and its acceptance are illegal, bad in law and in contravention to the rules framed under Article 77 of the Constitution of India.
We therefore call upon Cabinet Secretary to set aside the extant illegal order so that the legal and constitutional framework of the Nation is upheld.
